1. ABOUT THIS WEBSITE

This website is operated by Vivianne Strehle, trading under the brand name VIVIKINI. By visiting www.vivi-kini.com and/or placing an order through our online shop, you agree to be bound by these Terms of Service.

Please review our Shipping & Returns Policy before making a purchase. VIVIKINI reserves the right to modify these terms at any time. Continued use of this website after changes have been posted constitutes your acceptance of those changes.

If you do not agree to these terms, please refrain from using this website.

2. HANDMADE & MADE-TO-ORDER PRODUCTS

All VIVIKINI swimwear is ethically handmade to order in Germany. Each item is made individually based on your selected size, style, and color.

By purchasing, you agree that:

You are responsible for reviewing product descriptions and size guides before placing your order. If you are unsure, you are encouraged to contact us at vivikini18@gmail.com prior to checkout.
Your order becomes a legally binding contract once payment is completed at checkout.
You allow us up to 7 business days to cut, sew, and prepare your item for shipping.
Product descriptions may be updated or adjusted without notice.

3. PRICES & TAX

All prices listed on this site are in Euros (€).

As a small business under §19 UStG (Germany), we are exempt from charging VAT (Umsatzsteuer). No VAT is added or shown at checkout.

Note for Swiss customers: Import duties or taxes may apply upon delivery. These fees are not included in our prices and are the responsibility of the customer.

We reserve the right to change prices or correct pricing errors at any time.

4. PAYMENT

We accept the following payment methods:

Credit/Debit Cards
PayPal

Payment must be made in full before we begin production or shipping. We do not accept checks or direct bank transfers.

5. SHIPPING

We currently ship within the European Union and to Switzerland only.

Shipping Rates:

Germany & Switzerland: Free shipping
EU countries: Flat rate €15 (via DHL)

Estimated production time: up to 7 business days.

Delivery time after dispatch:

Germany & Switzerland: 1–2 business days
EU countries: 4-10 business days, depending on the destination

Once a package is handed to the courier, we are not liable for delays beyond our control.

6. ORDER MODIFICATIONS & CANCELLATIONS

Due to the custom, made-to-order nature of our products:

Orders cannot be changed or cancelled once submitted.
Multiple orders cannot be combined.
Orders will not be refunded if the recipient refuses the package at delivery.

7. RETURNS, ADJUSTMENTS & WITHDRAWAL RIGHTS

We do not accept returns or exchanges due to change of mind, sizing issues, or color variation.

If your item is faulty or you require an adjustment, please contact us at vivikini18@gmail.com within 14 days of delivery. Adjustments may be offered on a case-by-case basis and only if the item is:

Unworn
In original condition
Returned within 14 days of approval
Shipped at the customer’s expense

EU Right of Withdrawal:

As our products are custom-made, the 14-day right of withdrawal under EU law does not apply according to §312g Abs. 2 Nr. 1 BGB.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, VIVIKINI is not liable for any indirect, incidental, or consequential damages, including loss of data or profits, arising from the use of this website or our services.

We are also not liable for:

Slight variations in fabric color, fit, or texture
Delays caused by third-party couriers
Import duties or charges outside the EU
Unauthorized access to our servers or stored data despite security measures

9. USER ACCOUNTS

To access certain features of our website, users may create a personal account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.

We reserve the right to suspend or terminate your account at our discretion if we believe there has been unauthorized use, a violation of our terms, or any behavior that we deem inappropriate or harmful.
